Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Biz Geng platform, including our website, mobile applications, and all related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

Biz Geng is operated by the Biz Geng team. These Terms constitute a legally binding agreement between you and Biz Geng. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms, and "you" refers to both you individually and that entity.

You must be at least 18 years old to use this Service. By registering, you confirm that you meet this requirement.

2. Description of Service

Biz Geng provides a WhatsApp Business platform that enables businesses to:

• Connect their WhatsApp Business account for centralized customer communication
• Send bulk marketing and transactional messages to opted-in contacts
• Manage customer conversations through a shared team inbox
• Create automated responses and workflow triggers
• Showcase products through a digital storefront
• Access analytics and reporting on message performance

Biz Geng operates as a technology platform and does not act as a messenger, carrier, or data controller of the underlying WhatsApp messages. WhatsApp and its associated trademarks are properties of Meta Platforms, Inc. Biz Geng is not affiliated with or endorsed by Meta Platforms, Inc.

3. Account Registration & Security

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or are involved in suspicious activity.

4. Permitted Use & Prohibited Conduct

You agree not to:

• Use the Service to send unsolicited messages, spam, or content that violates applicable laws
• Send messages to contacts who have not explicitly opted in to receive communications from you
• Use the Service for any illegal, harmful, fraudulent, or deceptive purpose
• Harass, abuse, or harm another person or entity
• Transmit viruses, malware, or any technically harmful code
• Attempt to gain unauthorized access to other users' accounts or our systems
• Resell, redistribute, or sublicensen the Service without our prior written consent
• Use the Service to send content that infringes on intellectual property rights or is defamatory, obscene, or offensive

5. WhatsApp Business Platform

Your use of Biz Geng is subject to WhatsApp's Terms of Service and Business Guidelines. You are solely responsible for:

• Obtaining and maintaining your own WhatsApp Business account
• Ensuring your contact lists comply with WhatsApp's policies (including opt-in requirements)
• Complying with all applicable laws regarding electronic communications and data privacy in your jurisdiction
• Maintaining the quality and reputation of your WhatsApp Business account

If WhatsApp or Meta restricts or suspends your WhatsApp Business account, Biz Geng may also suspend your Service access. We are not liable for any action taken by WhatsApp or Meta against your account.

6. Fees & Payment

• Subscription fees are billed on a monthly basis unless otherwise stated.
• All fees are quoted in Indian Rupees (INR) unless otherwise specified.
• Payment is processed securely through our payment partners (e.g., Razorpay). We do not store your full payment card details.
• Taxes (including GST) will be applied where required by law and will be shown separately on your invoice.
• Refunds are handled on a case-by-case basis. Please contact support@bizgeng.com for refund requests.
• We reserve the right to modify pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Biz Geng and are protected by Indian and international intellectual property laws. You retain all rights to the content you create or upload through the Service (your business data, messages, and materials). By using the Service, you grant us a limited license to process and display your content solely for the purpose of providing the Service to you.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• Biz Geng provides the Service "as is" and "as available" without warranties of any kind, either express or implied.
• We do not guarantee uninterrupted, error-free, or secure operation of the Service.
• Biz Geng shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability to you for any claim shall not exceed the amount you have paid us in the 12 months preceding the claim.
• We are not responsible for the actions, content, or behavior of your customers or other third parties who interact with you through the Service.

9. Indemnification

You agree to indemnify, defend, and hold harmless Biz Geng and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your violation of these Terms
• Your violation of any rights of any third party
• Your content or messages sent through the Service
• Your violation of applicable laws or regulations

10. Termination

• You may close your account at any time through your dashboard settings.
• We may suspend or terminate your account if you violate these Terms, fail to pay applicable fees, or for any reason at our discretion with 14 days' written notice.
• Upon termination, your right to use the Service will cease immediately. We will make a good-faith effort to allow you to export your data for a reasonable period after termination, but we are not obligated to retain your data indefinitely.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts located in India.

Before filing any legal action, you agree to attempt to resolve the dispute informally by contacting us at support@bizgeng.com.

12. Miscellaneous

• If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
• Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
• You may not assign these Terms without our prior written consent.
• These Terms, together with our Privacy Policy, constitute the entire agreement between you and Biz Geng regarding the Service.
